Overview

The Dubai Land Department maintains the property register and administers transactions. RERA, its regulatory arm, regulates brokers, developers, escrow accounts and owners' associations.

Neither is a virtual-asset regulator. They matter to this practice in four specific ways.

Real estate as a DNFBP sector

Brokers, agents and developers are designated non-financial businesses and professions under the federal AML framework. That brings goAML registration, customer due diligence, real-estate activity reporting, and reporting of cash and virtual-asset payments above the relevant thresholds.

This is one of the most actively supervised DNFBP sectors in the country.

Paying for property with virtual assets

Value has to arrive in a form the escrow account and the registry can accept. In practice that means conversion through a licensed virtual-asset service provider, with the source of funds documented to the standard the bank, the developer and the registry will each apply.

The right way to approach this is as a compliance exercise with a payment step at the end, not as a payment method with compliance bolted on.

Tokenised title

The DLD and VARA have pursued tokenised title-deed work, and licensed platforms operate in the tokenised real-estate space.

Any such offering sits across two regimes at once. The property side must work under the registration and escrow rules. The token side must work under the virtual-asset issuance rules, and may additionally be a security. A structure that satisfies one and ignores the other is not a structure.

Residency through property

Property ownership at the relevant threshold supports long-term residence. Where the funds originate in virtual assets, the source-of-wealth file is the part that decides the outcome.
