Overview

Kuwait's Capital Markets Authority has taken a markedly more restrictive position on virtual assets than its neighbours, and the authorities have issued prohibitions on certain virtual-asset activity.

What a UAE firm needs to know

Kuwait should be treated as a do not market jurisdiction unless and until specific advice says otherwise. The cost of getting it wrong is disproportionate to the size of the opportunity.

Practically, that means geo-blocking, excluding Kuwaiti residents at onboarding, and documenting the decision so a supervisor can see it was deliberate rather than accidental.

What to verify

Positions change. Before treating this as settled either way, the current CMA and Central Bank of Kuwait statements should be checked.

How we help

We advise on market access before a sales team is pointed at a country, document the basis on which clients in each market are accepted or refused, and build the controls that make that basis hold. Where a second licence is genuinely needed, we run it.

Perguntas frequentes

  • Can we accept a Kuwaiti national living in Dubai?

Residence usually matters more than nationality, but not always, and the analysis depends on where the client is when they transact and how they were reached. This is a question to answer specifically rather than by general rule.
